Slip and Fall, Premises Liability

Premises Liability cases arise from injuries occurring in residential and commercial buildings, shopping centers and parking facilities, hotels and casinos, amusement parks, airports, healthcare facilities, nightclubs and bars, as well as universities and public schools. The general rule of law is that the owner or operator of the premises has a duty to keep the premises in reasonably safe condition or at least warn customers of a dangerous condition of which the owner or operator either caused, knows about, or should know about. If you or a loved one has been seriously injured as a result of dangerous premises then you may have the right to file a legal action.

Premises Liability

Property owners have a responsibility to their guests or patrons to insure that their property is maintained in a safe condition and does not pose a hazard.  Many times serious injuries and even death occur to patrons and guests because these property owners fail to live up to there legal responsibility.

There are many kinds of circumstances where a property owner may be liable for an injury or death, including the following:

  • Inadequate or negligent security

  • Improper storage procedures

  • Inadequate or unsafe flooring or stairways

  • Presence of poisonous substances or materials

  • Inadequate or inoperable alarm systems

  • Locked or unavailable escape options

  • Lack of proper safety equipment
